§ 1 General Provisions, Scope

(1) These General Terms and Conditions (hereinafter “Terms”) govern the use of the website drive-bee.de (hereinafter “drive bee” or “Platform”), operated by Jasper Behnke, Tauroggener Straße 15, 10589 Berlin, Germany (hereinafter “Operator”).

(2) A user within the meaning of these Terms is any natural person who uses the Platform, regardless of whether they have registered (hereinafter “User”).

(3) German law applies. The place of jurisdiction for merchants is Berlin.

(4) The contractual languages are German and English.

§ 2 Description of Services

(1) drive bee is a comparison portal for driving schools. The Platform enables Users to search for driving schools free of charge and to compare prices, locations, and other information.

(2) drive bee is not a contracting party in any agreements between Users and driving schools. drive bee does not broker contracts and does not act as a representative or agent of any driving school.

(3) The information presented on the Platform is non-binding. drive bee does not guarantee the completeness, accuracy, or timeliness of the data displayed.

(4) The data is sourced from publicly available sources, Google Maps, and information entered directly by driving schools.

§ 3 Use Without Registration

(1) The core functions of the Platform — in particular, driving school search, price comparison, and location search — are available to all Users without registration.

(2) Registration is required for use of the driving school management portal (Instructor Portal).

§ 4 Registration and User Account

(1) Registration is only available to natural persons with full legal capacity.

(2) The User is obligated to provide truthful and complete information during registration and to keep it up to date.

(3) The User is obligated to keep their password confidential and to protect access to their account from third parties.

(4) Use of drive bee is currently free of charge (Basic). Paid features (e.g., Pro or Premium functions) may be introduced in the future. Registered Users will be informed of pricing changes in a timely manner.

(5) drive bee is entitled to temporarily or permanently suspend user accounts in case of misuse.

(6) The User may delete their account at any time. The right to deletion of personal data pursuant to Art. 17 GDPR remains unaffected.

§ 5 User Obligations

(1) The User undertakes not to misuse the Platform.

(2) In particular, the following is prohibited:

  • automated scraping or extraction of Platform content,
  • posting or distributing unlawful content,
  • excessive loading of the technical infrastructure,
  • use of the Platform under a false identity.

(3) The User is obligated to provide truthful information.

§ 6 Intellectual Property

(1) All content published on the Platform, in particular the processed comparison data, texts, graphics, and design, is protected by copyright.

(2) Commercial reuse of the content requires the prior written consent of the Operator.

§ 7 Limitation of Liability

(1) The Operator is fully liable for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.

(2) In cases of slight negligence, the Operator is only liable for breach of material contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable, typically occurring damages.

(3) drive bee assumes no liability for the accuracy, completeness, or timeliness of the driving school information displayed on the Platform.

(4) drive bee does not guarantee uninterrupted availability of the Platform.

§ 8 Data Protection

(1) Information on the processing of personal data can be found in our Privacy Policy.

(2) Data processing is carried out in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

§ 9 Amendments to the Terms

(1) The Operator reserves the right to amend these Terms at any time. Registered Users will be notified of changes by email at least four weeks before they take effect.

(2) If a registered User does not object to the changes within four weeks of receiving the notification, the amended Terms shall be deemed accepted.

(3) In case of objection, the Operator is entitled to terminate the usage agreement at the time the new Terms take effect.

§ 10 Final Provisions

(1) Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by such valid and enforceable provision that most closely reflects the economic purpose of the invalid or unenforceable provision.

(2) The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/.

(3) drive bee is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
